On the other side, the registered user of the webpage, using a username and password to which have plain responsibility of use, being responsible for the veracity of his/her personal data facilitated to CONOR. The user when using the web is committed to:

i. Using the web only to make queries or orders legally valid.

ii. Not making fake or fraudulent orders

iii. Provide and keep updated all the contact information that is necessary. If the user does not provide us with all the mandatory information, we will not be able to attend the request. When placing an order, the user declares that they are over 18 years old and have the legal capacity to enter contracts.

3. PURPOSE OF THESE GENERAL CONDITIONS

The purpose of these general conditions is to regulate the contractual purchase-sale relationship between CONOR and the user at the time that the user accepts during the online contracting process, by checking the corresponding box, entering the requested information, and making the payment.

The contractual relationship of sale entails the delivery, in exchange for a certain price and publicly exposed through the website, of a specific product or service.

4.- CONTRACTING PROCEDURE. HOW TO ORDER

To access the services offered by CONOR, the user must register on this website by creating a user account. To do this, the user must freely and voluntarily provide the required personal data.

The user will select a username and a password, committing to make diligent use of them, and not to provide them to third parties, as well as to notify CONOR of the loss, theft or possible access by an unauthorized third party. In that case, CONOR will proceed to the immediate blockade.

Once the user account has been created, it is reported that in accordance with the requirements of art. 27 of Law 34/2002 on Services of the Information Society and Electronic Commerce, the contracting procedure will follow the following steps:

1.       Select the products of interest to purchase. Each selected product is automatically added to the "shopping cart".

2.       Once the product(s) to be purchased has been selected, a summary of the order with all the selected products will be displayed on the "shopping cart" screen. If having a discount code, the user must check the appropriate box.

3.       Identification. If it is the first time ordering with CONOR, the user must check the box to the right and click 'Create Account'. A new window will appear on the screen. The user must enter personal data (mandatory fields: name and surname, telephone and email address) and create an account. Name, country, address, city, postal code and telephone number.

If the user has already placed online orders with CONOR, he must identify himself by entering his email address on the right of the page. His data will appear automatically once he has entered his email address and password.

4.       Address. If you wish, modify the delivery or billing address, if they are different from the ones provided during the account creation process.

5.       Shipping costs. Free for certain amounts. In any case, they are specified for each order. The user must read the corresponding section.

6.       Payment method. Several payment options are available to the user.

7.       To continue, the user must accept the General Conditions of Sale and click "Next".

The user must click on "Secure payment" to pay the order directly by credit card. CONOR’s system guarantees the safety of the operation.

Order confirmation. Once the order has been validated, the user will receive a confirmation email. This message will include username, order description, price and shipping address.

CONOR system records the date and content of the order, which is subject to subsequent verification by our services to verify its conformity with the description of the product offered at the time the order is placed.

AVAILABILITY OF THE SERVICE. Regarding the Spanish territory, the articles offered on this website will not be available for shipment to the Canary Islands, Ceuta, and Melilla.

5. DELIVERY OF ORDERS

The delivery times are for products with immediate availability.

The prices are understood with VAT included. As with shipping costs, in the case of international shipments, any charges derived from customs taxes or public fees must be assumed by the user.

The delivery of orders will be made at the delivery address freely designated by the user. In this way, CONOR does not assume any responsibility for when the delivery of the product or service does not take place as a result of the data provided by the user being wrong, inaccurate or incomplete or when the delivery cannot be made for reasons beyond the control of the shipping company, assigned for this purpose, as is the absence of the recipient.

CONOR undertakes to deliver the bicycle at the door of the house or entrance to the building.

Once the order has been placed, and the amount paid, a confirmation email will be received within a maximum period of 24 hours, in which the availability of the product and the delivery period will be confirmed.

Normally, orders can be delivered within 2-3 business days approximately (Peninsula and Balearic Islands) and 4-5 business days approximately for sales within the EU.

In case of delay in delivery, the user can contact CONOR, through any of the communication channels indicated.

The order will be sent to the address indicated at the time the purchase was made, by means of a transport company.

It is advisable, at the time of delivery, to verify that everything is in accordance with the order and in perfect condition. If the user does not agree with the items delivered or their condition, he must sign and indicate by hand on the carrier's delivery note the anomalies he found upon receipt.

It will be understood that the delivery has taken place at the moment in which the order has been delivered to the person who has purchased it or to another indicated by him. The order will be understood as delivered when the material possession of the purchased items is acquired, which will be accredited by signing the delivery note of the order at the delivery address requested by the purchaser.

The buyer bears any risk from the time of delivery.

 

If damage or breakage is observed in the packaging, the carrier must be informed at the time the product is received and CONOR informed within a period not exceeding 24 hours in order to manage the timely claim.

6. PRICE

The price of the products will be the one established at the time of purchase on the website, except in the event of manifest error. Although CONOR tries to ensure that all prices on the page are correct, errors may occur. If CONOR discovers an error in the price of any of the products that the user has ordered, CONOR will inform the user as soon as possible and give the user the option of reconfirming the order at the correct price or canceling it. If CONOR is unable to contact the user, the order will be considered canceled and the amounts that have been paid will be fully refunded. CONOR will not be obliged to supply the user with any product at a lower incorrect price (even if CONOR has sent the user the Dispatch Confirmation) if the pricing error is obvious and could reasonably have been recognized by the user as an incorrect price.

The prices applicable to each product will be those published on the website and applied automatically by the contracting process in its last phase. All prices published on the website, except for omissions or transcription or computer errors, are valid and include the corresponding VAT.

The prices on the website include VAT but exclude shipping costs (and possible customs taxes or public fees on international sales), which are added to the total amount due.

Prices may change at any time, but changes will not affect confirmed orders.

7. SHIPPING COSTS

The preparation and shipping costs vary depending on the amount:       

o PENINSULA AND BALEARIC ISLANDS

Free for orders greater than or equal to €100.

€10 for orders below €100.

 o SHIPMENTS WITHIN THE EU

       Free for orders greater or equal to €500 (+ possible customs taxes or public fees on international sales).

39€ for orders below €500 (+ possible customs taxes or public fees on international sales).

No shipments are made to the Canary Islands, Ceuta, and Melilla. You can always do it through the CONOR/WRC dealer in the area.

The products offered in this service are aimed at final consumers under the terms and conditions provided by the Retail Trade Law. In this sense, any purchase request outside the parameters of an average consumer and/or massive requests for orders from the same buyer and/or recipient may not be met.

These costs are subject to possible review based on variations in the transport company.

8. PAYMENT METHODS

CONOR puts at your disposal the following forms of payment.

Payment by credit/debit card

If the user chooses to pay by card, the order will not be considered and will not be processed until the payment has been authorized by the bank or cashier. Online payment by credit card is made through the bank payment platform. In this case, additional data could be requested or required in order to accept the purchase. CONOR reserves the possibility of enabling a procedure by which and for any order whose amount is greater than a scale set by CONOR, the user will be asked for an identity document and a proof of address that the user must send to CONOR by fax or to the email that will be sent in due course are indicated. Although this procedure may delay the processing of the order, its purpose is to ensure that the author of the order is really the owner of the card used. This security measure is proof of our willingness to protect our customers against possible fraud or theft.

SERVICE AVAILABILITY

The items offered through this website are only available for shipment to the enabled countries.

9. AVAILABILITY OF PRODUCTS

All orders are subject to products availability. If incidents occur regarding its supply, or if the product is not available, the user will be informed as soon as possible and will be allowed to modify the order or cancel it.

 

10. VALUE ADDED TAX AND BILLING

In accordance with the tax regulations on Value Added Tax, the delivery of the items will be understood to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory, except for the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be that legally in force in each country and for each product or service. In orders destined for the Canary Islands, Ceuta and Melilla, deliveries will be exempt from VAT but subject to the taxes corresponding to these territories. The user expressly authorizes CONOR to issue the invoice electronically, although he/she may at any time indicate the wish to receive a paper invoice, in which case CONOR will issue and send the invoice in that format.

11. RETURN POLICY. RIGHT OF WITHDRAWAL

If the user is contracting as a final consumer and not as a distributor, he/she has the right to withdraw from this contract within a period of 14 calendar days without the need for justification, according to Art. 9 of Directive 2011/83/EU on consumer rights.

The withdrawal period will expire 14 calendar days from the day on which the user or a third party indicated by the user, other than the carrier, acquired material possession of the goods, that is, since they were delivered.

To exercise the right of withdrawal, the user must send to CONOR a written communication through the contact addresses indicated above.

The user can use the model withdrawal form that appears as an Annex to these Conditions or send CONOR a letter that collects at least the information necessary for the correct identification of the order.

In the event of withdrawal by the user, CONOR will refund all the payments received from the user, including the delivery costs (except for additional costs resulting from a choice of a delivery method other than the least expensive delivery method). Without undue delay and, in any case, no later than 14 calendar days from the date on which CONOR is informed of the user’s decision to withdraw from this contract. CONOR will proceed to make the mentioned refund using the same means of payment used for the initial transaction. The user will not incur in any costs because of the reimbursement. Notwithstanding the foregoing, CONOR may withhold reimbursement until CONOR has received the goods, or until the user provides proof of return of the goods, whichever condition is met first.

Once the product has been received in CONOR’s warehouses, and after checking its status, the amount and shipping costs will be reimbursed, using the same method of payment made by the customer and, in any case, within a period not greater than 14 calendar days from receipt of the returned merchandise. The direct cost of returning the good or service will be assumed by the client as stated in the General Law on Consumers and Users (Royal Legislative Decree 1/2007) and Directive 2011/83/EU on consumer rights.

There are exceptions to the right of withdrawal. The refund will not be applicable to:

The supply of goods made according to the specifications of the consumer and user or clearly personalized (for example: tailored clothing, personalized clothing such as sports shirts with a personal name).

The supply of sealed goods that are not suitable to be returned for health or hygiene and that have been unsealed after delivery (for example: earrings, all beauty items, toiletries, cosmetics, personal hygiene, hair accessories, underwear, stockings and tights, and all those products for body use).

The supply of sealed sound recordings, videos, video games and computer programs provided on any physical medium (CD, Vinyl, DVD, Blu-ray, etc.), which have been unsealed by the consumer and user after delivery.

The provision of digital content that is not provided on a material medium.

The user has a withdrawal form as an annex to these general conditions.

12. LIABILITY AND RELEASE OF LIABILITY

CONOR's liability in relation to any product purchased on this website will be strictly limited to the purchase price of said product.

All descriptions of products, information and materials that appear on this website are provided "as a true body" and without express or implied warranties about them except those established by law. In this sense, CONOR undertakes to deliver articles that are in accordance with the contract, responding to any lack of conformity that exists at the time of product delivery. It is understood that the products are in accordance with the contract provided if they:

(i) conform to the description made by CONOR and possess the qualities presented on this website,

(ii) are suitable for the uses to which products of the same type are ordinarily destined and

(iii) present the usual quality and benefits of a product of the same type that are reasonably expected.

CONOR certifies that the delivery deadlines indicated on the website www.conorbikes.com are merely informative, without it being possible to initiate any claim action to which the client may be entitled and that they may exercise against CONOR because of delays in the delivery of orders for reasons not attributable to CONOR. The client declares to exonerate CONOR SPORTS SA from any type of responsibility that is a consequence of a delay in the delivery of the selected order.

13. GUARANTEE

In relation to the guarantee of products, as indicated by the European Consumer Center, in Spain, the new Royal Decree Law 7/2021, of April 27th, grants consumer goods a legal guarantee of 3 years from of the delivery date. The consumer and user must inform the seller of the lack of conformity within two months from when he became aware of it.

Deficiencies caused by negligence, blows, improper use or handling, unsuitable voltage, incorrect installation not carried out by the authorized Technical Service when appropriate, or materials subject to waste due to normal use are not included.

In the case of computer items, the warranty will not cover the removal of viruses, restoration of programs for this reason or the reinstallation of the disk caused by deleting it.

In those incidents that justify the use of the guarantee, the repair, replacement of the item, discount or return will be chosen, in the legally established terms.

For any change or return it is essential to present documentation that proves the sale and/or invoice. Said documents are the confirmation and/or delivery emails. The user must contact CONOR through the telephone numbers and addresses indicated above.

14. INDUSTRIAL AND INTELLECTUAL PROPERTY

The brands and logos that appear on this website are registered and cannot be used without a written agreement with the person responsible for the website. CONOR is the owner or holds a license for its use.

15 COMMUNICATIONS BETWEEN CONOR AND THE USERS

Consumer legislation requires that some of the information or communications that CONOR sends to the user should be written. For this reason and by accepting these general conditions, the user accepts that said communications with CONOR will be by any of the electronic means that the user has provided. For contractual purposes, the user consents to the use of electronic means of communication and acknowledge that all contracts, notifications, information and other communications that CONOR sends him/her electronically comply with the legal requirements of being in writing. This condition will not affect the user’s rights as a consumer recognized by law.

16. FORCE MAJEURE

CONOR will not be responsible for the delays or failures that occur in the access, operation and operability of the Web, its Contents and/or Services, nor for the interruptions, suspensions or malfunctions of the same, when they have their origin in breakdowns caused by natural catastrophes such as earthquakes, floods, lightning or fires, situations of force majeure, situations of extreme urgency such as wars, military operations, civil disturbances, strikes, lockouts or any other situation of force majeure or fortuitous cause.
